PRIVACY NOTICE (MEXICO)

1. Definition of Personal Information and Activity of its Protection

Hitachi, Ltd. (hereinafter referred to as "Hitachi") domiciled at 1-18-13, Soto-Kanda, Chiyoda-ku, Tokyo, 101-8608, Japan shall define that personal information means any information that identifies you or could reasonably be used to identify you or another person (examples of personal information include your name and your e-mail address). In addition, pursuant to Mexican Data Privacy Law, personal information shall not be limited to personal identifiers, but includes any numerical, alphabetical, graphic, photographic, acoustic or other information, concerning an identified or identifiable individual.

Please be informed that Hitachi protects and manages the personal information collected in terms of this Privacy Notice by establishing a manager on a department basis with the greatest care and the best effort based on the "Hitachi Privacy Notice". And, from the viewpoint of the protection of the person’s ARCO Rights (as defined in Section 5. Request to exercise ARCO Rights, Restrict the Use and Disclosure of Personal Information or Revocation of Consent or Raising Complaints) and interests of the Concerned Persons, Hitachi makes efforts to consider the following points.

  1. Responding to request to exercise of ARCO Rights from Concerned Persons about their retained personal data by voluntarily stopping its use, and by stopping the sending of direct mail to the Concerned Person. For purposes of this Privacy Notice, Concerned Person shall mean any data-owners.

  2. Whether information is entrusted to others or not, promoting the clarification of outside processing, such as clarifying the details of work done outside the business by outsourcers (processors of the data on behalf and per the instructions of Hitachi).

  3. Clarifying the purpose of use more to the Concerned Persons through activities related with the business voluntarily limiting the purpose of use based on the selections of the Concerned Persons or the business limiting and showing the purpose of use by type with consideration to the details of the work.

  4. Specifying as concretely as possible the source personal information was acquired from and the method of acquisition (the type of acquisition source, etc.) on the procedures to meet requests for disclosure and others.

2. Scope of Application

This Privacy Notice, establishes the Hitachi's procedures for handling, collecting, using, transferring, storing and disclosing personal information.

 

3. Handling Policy of Personal Information -Collection/Usage Purpose and Transfer Provisions to Third Party

3.1. PERSONAL DATA COLLECTED BY HITACHI
Hitachi collects the following personal data when you submit an inquiry and in order to achieve the purposes mentioned below

• First Name

• Last Name

• E-mail address

• Phone Number

• Company

• Birth date

• Organization (e.g. name of company or school)

• Postal code

• Information related to the issue you are contacting us about

3.2. PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA.
Main purpose:

  1. In relation to Hitachi's main business activities for electrical machinery parts, information communication machinery parts, electronic parts manufacturing and the information service, Hitachi will collect and use the personal information set forth in Section 3.1 (Personal Data Collected by Hitachi) only to achieve each the purposes established in this Section. For more details of our business activities, please see our website about each division.

  2. Execution of a contract concluded between Hitachi and a customer.

  3. Contacts for business negotiations and meetings with a customer.

  4. Response to various inquiries from a customer.

  5. Delivery of after-sales service on products.

  6. Execution of business, including system development, operation and maintenance, entrusted by customers.

  7. Delivery of various membership services agreed with customers.

Secondary purposes:

  1. Affairs of stocks.

  2. Analysis based on questionnaires to improve products and services.

  3. Provision of personal information to the group company in case of co-operation with them.

  4. Sending of information on events and new products.

If you do not want your personal information to be used for the secondary purposes listed above, please follow the procedure set forth in our Privacy Notice (Mexico) (Appendix).

3.3. TRANSFERS OF PERSONAL INFORMATION TO A THIRD PARTY

  1. Hitachi will not provide personal information to a third party without first obtaining consent of the person through this Privacy Notice, except in the following cases:

    1. Cases in which the provision of personal information is based on laws.

    2. Cases in which the provision of personal information is essential for medical attention, prevention, diagnosis, health care delivery, medical treatment or health services management, where the data owner is unable to give consent in the terms established by the General Health Law (Ley General de Salud) and other applicable laws, and said processing of data is carried out by a person subject to a duty of professional secrecy or an equivalent obligation

    3. Cases in which the provision of personal information is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the person.

    4. Cases in which the personal information is requested by a competent Mexican authority.

    5. Cases in which the personal information is contained in publicly available sources.

    6. Cases in which the personal information is subject to a prior anonymization procedure.

    7. Cases in which the transfer is necessary to fulfill the obligations under a legal relationship between the data owner and the data controller

    8. Cases in which the transfer is pursuant to a law or international treaty to which Mexico is a party.

    9. Cases in which the transfer is necessary by virtue of a contract executed or to be executed in the interest of the data owner between the data controller and a third party.

    10. Cases in which the transfer is necessary or legally required to safeguard public interest or for the administration of justice; and

    11. Cases in which the transfer is necessary for the recognition, exercise or defense of a right in a judicial proceeding.

  1. Hitachi will also transfer personal information to the following parties with your prior consent:

  1. Cases in which personal information is provided as a result of the take-over of business in a merger or otherwise.

  2. Cases in which the provision of personal information is especially necessary for improving public hygiene or promoting the sound growth of children and in which it is difficult to obtain the consent of the person.

  3. Cases in which an entry handling personal information entrust the handling of personal information in whole or in part within the scope necessary for the achievement of the purpose of use.

Should you not wish your personal data to be transferred to such third parties, please follow the procedure set forth in our Privacy Notice (Mexico) (Appendix). In case we do not receive a communication form you in such regard we will understand in good faith that you agree with Hitachi sharing your information with such third parties
Third parties and entities receiving personal information will assume the same obligations and/or responsibilities as Hitachi, according to what is described in this Privacy Notice.

 

4. About Usage of Cookies and Web beacons

Hitachi uses visible adverts notifying the existence of cookies*1 and Web beacons (clear GIF)*2in part of the website to make it more conveniently to use for person.
A person can refuse to receive a cookie, or can display a warning message when receiving a cookie by changing the setting of a web browser. For more details, please see the instructions of a web browser you are using. Moreover, a person can reject a Web beacon by setting to refuse the receipt of a cookie.
But, in the first case, please note that a person may not be able to use the all or part of our services provided in the website.

Mean information exchanged one another between a web server that controls a web site and a web browser that a person uses. Cookies may be saved as files in the disk of a person's PC. If you use a cookie, the web server can track and record information about which pages in the web site the particular computer visits. However, we cannot identify the person unless he or she enters the personal information into the web site. The purpose to collect this information is only used to measure activity on our site and to develop ideas for improving our site.

5. Request to exercise ARCO Rights and Restrict the Use and Disclosure of Personal Information or Revocation of Consent or Raising Complaints

When a person wants to request to limit the use and disclosure of his/her personal information and/or exercise his/her ARCO Rights, or revoke his/her consent to the processing of his/her personal data, or wants to raise complaints, the person is requested to follow the procedures set forth in our Privacy Notice (MEXICO) (Appendix).

ARCO Rights are the rights that every data-owner has to (i) access his/her personal data held by Hitachi and be informed about the way in which the information is processed, (ii) rectify his/her personal data in case it is not up-to-date, it is inaccurate or incomplete, (iii) cancel his/her personal data that in his/her view is not used in accordance with the applicable principles, duties and obligations, and/or (iv) object to the processing of his/her data for specific purposes.

6. Request to person

  1. While most of Hitachi's services can be used without the personal information, please note that some services are only available with the submission of the personal information.

  2. Please note that Hitachi is not responsible for the security of personal information in any non-Hitachi web site whose link is included in the Hitachi's web site.

  3. If a person enters the personal information into the Hitachi's website, he or she is required to agree upon the provisions in this Privacy Notice, otherwise you may not use our services (including response to inquiries). Also, if you are aged at 18 or younger, please enter the personal information with the consent of a parent or guardian.

7. Special Note

  1. Our personal information protection policy shall be in accordance with the laws of Mexico.

  2. Hitachi may revise this Privacy Notice” to improve the handling of personal information and/or due to the revision of laws or ordinances, or other rules or regulations.

  3. The implementation of this Privacy Notice," shall be after the issued date (or revised date).

  4. If each Hitachi website has its own personal information policy, this policy shall supersede the provisions of any other policies in the Hitachi websites.

  5. If a person calls us and provides his/her consent, Hitachi may tape the call to ensure offering clearer answers.
